The digital content published on the HippoPlace platform may come from different sources.
Content supplied directly by manufacturers, suppliers, sellers, distributors or other third parties remains the property of the respective rights holders, unless otherwise agreed in writing. HippoPlace does not claim any ownership over photographs, videos, graphics, texts, product sheets, commercial materials or other content received already prepared from the seller or the manufacturer, where such content has not been produced, modified, processed or commissioned by HippoPlace.
Conversely, all digital content produced, manufactured, photographed, filmed, processed, optimised, commissioned or created directly by HippoPlace for the promotion, enhancement, presentation and sale of specific products available on the platform is and remains the exclusive property of HippoPlace, unless otherwise agreed in writing.
This category includes, by way of example and not limitation, product photographs taken by HippoPlace, videos, banners, graphics, images optimised for e-commerce, social media content, advertising creatives, materials for advertising campaigns, images intended for product feeds, editorial texts, rewritten or enriched product sheets, promotional content and any other digital material produced or reworked by HippoPlace.
Such content is produced through economic, technical, creative and organisational investment on the part of HippoPlace and is intended exclusively for use on channels directly managed, authorised or controlled by HippoPlace, including the website, the e-commerce platform, any connected marketplaces, advertising campaigns, digital communication tools, product feeds and promotional activities attributable to the platform.
The manufacturer, supplier, seller, distributor, merchant, reseller or any other third party does not acquire any right of ownership, use, reproduction, publication, distribution, modification, storage, transmission, sub-licensing or commercial exploitation over the content produced by HippoPlace by the mere fact that it represents, describes or promotes products supplied, manufactured, distributed or marketed by them.
It is therefore expressly prohibited, save for prior written authorisation from HippoPlace, to copy, download, save, reproduce, reuse, publish, modify, distribute, transmit or make available to third parties the digital content produced, modified or optimised by HippoPlace.
This prohibition applies, in particular, to the use of the content on third-party e-commerce sites, marketplaces, digital catalogues, product feeds, Google Merchant Center, Google Shopping, Performance Max campaigns, Google Ads campaigns, price comparison websites, social networks, promotional materials, price lists, management systems, CDNs, digital archives or any other commercial, advertising or informational channel not expressly authorised by HippoPlace.
The possible availability of the content on the HippoPlace platform, on product pages, in commercial materials, in technical feeds or in operational areas does not constitute an assignment, an implicit licence, an authorisation to use, an authorisation to copy or an authorisation to redistribute on the part of manufacturers, suppliers, sellers, distributors, resellers, merchants or other third parties.
The possible receipt of the content by manufacturers, suppliers, wholesalers, distributors, agencies, intermediaries, platforms, data feeds or other parties does not constitute a legitimate title to use it, where such parties have not been expressly authorised by HippoPlace to grant its use to third parties.
Any unauthorised use of the digital content produced, modified or optimised by HippoPlace shall be considered an infringement of intellectual property rights and an undue exploitation of materials created with economic, technical and creative investment by HippoPlace.
In the event of unauthorised use, HippoPlace may demand the immediate removal of the content from all channels on which it appears published, uploaded, distributed or indexed, including websites, CMSs, management systems, CDNs, caches, marketplaces, product feeds, Google Merchant Center, Google Shopping, Google Ads, Performance Max campaigns, price comparison websites, social networks and digital archives.
HippoPlace further reserves the right to report such use to search engines, advertising platforms, marketplaces, hosting providers, technology providers and other competent parties, as well as to claim damages, the payment of a fee for unauthorised use of the licence and any further remedy provided for by the applicable legislation.
Any possible granting of use of the digital content produced by HippoPlace must be authorised in advance in writing and governed by a specific agreement, indicating the content granted, the duration, the authorised channels, the purposes of use, the territorial scope, any authorised parties, the consideration and any prohibition of sub-licensing or redistribution to third parties.
In the absence of written authorisation, the use by third parties of the digital content produced, modified or optimised by HippoPlace shall always be deemed prohibited.
